Law Enforcement Requests

Law Enforcement and Government Authority Request Guidelines

1.Purpose

These Guidelines describe how FastBTCatm.ca and its applicable operating entities review and respond to lawful requests for information relating to FastBTCatm services, websites, applications, and Bitcoin ATM operations.

These Guidelines apply to requests submitted by law enforcement agencies, regulatory authorities, financial intelligence units, courts, prosecutors, and other legally authorized government authorities seeking information from FastBTCatm.

2.General Principles

FastBTCatm respects applicable privacy, data protection, anti-money laundering, counter-terrorist financing, and financial crime laws. FastBTCatm will disclose customer information only where required or authorized by applicable law.

FastBTCatm reviews requests individually and may:

  • verify the authenticity and legal validity of a request;
  • request additional documentation, clarification, or legal process;
  • reject or decline requests that are incomplete, unauthorized, overbroad, informal, or inconsistent with applicable law;
  • require requests to be submitted through appropriate official channels.

Submission of a request does not guarantee disclosure of information.

3.Authorized Requesting Parties

FastBTCatm generally processes requests only from duly authorized:

  • law enforcement agencies;
  • regulatory authorities;
  • financial intelligence units;
  • prosecutorial authorities;
  • courts and judicial bodies;
  • other governmental entities with lawful authority to request information.

Requests submitted by private parties, attorneys, investigators, or other third parties without appropriate legal authority may be declined.

4.Submission Requirements

Requests should be submitted in English and sent from an official government, court, regulator, or agency email address.

Each request should include:

  • full name of the requesting authority;
  • name, title, and badge or identification number of the requesting officer or official;
  • official agency email address;
  • official mailing address and telephone number;
  • applicable legal basis for the request;
  • reference, case, file, warrant, subpoena, production order, court order, regulatory demand, or investigation number, if applicable;
  • detailed description of the information being requested;
  • relevant deadline, if any.

FastBTCatm may request additional verification or legal process before responding.

5.Information Helpful for Investigations

To facilitate efficient processing, requesting authorities should provide any available identifying information, including:

  • Bitcoin wallet address;
  • transaction hash or TXID;
  • ATM location;
  • date and time of transaction;
  • transaction amount;
  • customer name or identifying information;
  • phone number or email address associated with the transaction;
  • any other relevant investigative details.

Providing sufficient transaction details helps reduce processing delays and improves the likelihood of locating responsive records.

6.Preservation Requests

FastBTCatm may, where legally permitted and operationally feasible, preserve available records for a limited period in response to a written preservation request from a legally authorized authority.

A preservation request does not itself authorize disclosure of customer information. Disclosure generally requires valid legal process or another applicable legal basis.

7.Emergency Requests

Where there is an imminent threat to life, serious bodily harm, terrorism, kidnapping, or another emergency threatening the life, health, or security of an individual, FastBTCatm may expedite review of an emergency disclosure request where permitted by applicable law.

Emergency requests must clearly describe the emergency, explain why disclosure is required without delay, and include supporting documentation where available.

FastBTCatm reserves the right to determine whether a request qualifies for emergency processing and whether disclosure is legally permitted.

8.Foreign Requests

Requests from authorities outside Canada may require Canadian legal process, mutual legal assistance treaty procedures, or another legally recognized basis before FastBTCatm can disclose customer information.

FastBTCatm may decline or request clarification for foreign requests that do not identify an applicable legal basis.

9.Processing Time

FastBTCatm will make reasonable efforts to review and respond to valid requests in a timely manner.

Response times may vary depending on:

  • the scope and complexity of the request;
  • the availability of responsive records;
  • legal review requirements;
  • verification of requesting authority credentials.

Unless otherwise required by law, court order, or urgent circumstances, authorities should allow at least ten (10) business days for processing.

10.Data Availability

FastBTCatm can only provide information that is:

  • in its possession, custody, or control;
  • retained pursuant to applicable laws and retention policies;
  • legally permitted to be disclosed.

FastBTCatm cannot provide information that it does not collect, possess, or retain.

11.Confidentiality

Communications between FastBTCatm and requesting authorities may contain sensitive investigative, customer, or business information.

FastBTCatm expects information disclosed in response to a request to be used only for lawful governmental, regulatory, judicial, or investigative purposes and handled in accordance with applicable confidentiality and data protection requirements.

12.Reservation of Rights

FastBTCatm reserves all rights available under applicable law, including the right to:

  • challenge, narrow, or seek clarification regarding requests;
  • require appropriate legal process before disclosure;
  • notify affected users where permitted or required by law;
  • decline requests that exceed legal authority or jurisdiction.

13.Accuracy and Limitations

FastBTCatm makes reasonable efforts to provide accurate and complete information based on available records. Information may be limited by data availability, retention periods, technical limitations, system availability, or other operational factors.

Nothing in these Guidelines limits any obligation FastBTCatm may have under applicable law or valid legal process.
